The trial was delayed for a wrongful death accident of a moped rider who was hit and killed last August. Reports say the accident occurred when a pickup truck collided with a moped in a Kennewick intersection. The moped hit the front passenger side as the pickup was turning north onto Edison Street. Traffic camera video evidence shows the moped’s headlights where on and should have been visible to the pickup truck driver. However, investigators have found that the driver of the pickup truck was under the influence of marijuana and had also been drinking alcohol earlier that day. To make matters even worse, the pickup truck driver briefly stopped after the collision, got out of the truck, but never walked over to check on the dying moped rider. She never called 911 but did call her boyfriend according to police. Investigators say she drove away from the accident scene but returned and parked behind a nearby business in a parking lot. Police located her 11 minutes after the crash. The pickup truck driver has been charged with two felonies, vehicular homicide, and hit and run with death. Since posting $50,000 bond, she has been out of custody for five weeks. Her trial has been delayed until February 2019 but the judge has ordered her to wear an alcohol-monitoring device while awaiting trial.
Wrongful Death Accident of Moped Rider
As a moped rider, the driver acts just like the driver of any other vehicle on the road. Thus, the driver and their surviving family members are entitled to the same rights as any other driver. A moped accident claim is similar to a motorcycle accident claim. Oftentimes, the only way to recover a fair settlement in a catastrophic injury accident or wrongful death case is to file a lawsuit and fully litigate the claim. Keep in mind; any criminal lawsuit is completely separate from a wrongful death lawsuit. Sometimes, the insurance company will force the case to go to a civil trial. Thus, the surviving family would need to seek experienced legal counsel to make sure they receive a fair and honest settlement.
