Workers on Roads and Highways in Work Zones Have the Right-of-Way

Workers on roads and highways in work zones have the right-of-way according to the Washington Rules of the Road.  This includes the workers, motor vehicles and other equipment necessary for the work on the road.  According to the Washington Department of Transportation (WDOT), Washington averages almost 850 car crashes in highway work zone areas every year. The top three causes of those car accidents are:

  1. Distracted/Inattentive driving,
  2. Following Too Close, and
  3. Speeding

According to WDOT 96% of individuals injured or killed in work areas are drivers and passengers.

To help protect yourself and others, WDOT has the following survival tips to help ensure your own safety, as well as the safety of others:

  1. Slow down to posted speed limits
  2. Pay Attention
  3. Merge as soon as possible
  4. Expect Delays, plan for them or use an alternative route when necessary[i]

The laws concerning Persons Working on Highway Right-Of-Way as stated in the Washington Rules of the Road are as follows:

46.61.030: Persons working on highway right-of-way—Exceptions.

Unless specifically made applicable, the provisions of this chapter except those contained in RCW 46.61.500 through 46.61.520 shall not apply to persons, motor vehicles and other equipment while engaged in work within the right-of-way of any highway but shall apply to such persons and vehicles when traveling to or from such work.
