Dog Owners Are Liable for Injuries


Dog owners are liable for injuries or damages the dog causes.  This can be for dog bite injuries that occur in a public place or for injuries that occur to someone lawfully on your private property. Under Washington law, when a person enters your private property who has express or implied consent to be on the property can hold you responsible for damages they sustain because of your dog injuring them.  This express or implied consent will not be presumed when your property is fenced or there are posted signs providing warning of there being a dog or no trespassing signs.

To help prevent injuries to others, you should make sure your dog is within your control.  This could be having your dog in well-kept fenced yard, inside your home, on a leash, etc. Additionally, it is always a good idea to have signs to warn others that there is a dog on the premises, even if Spot has never harmed a soul.

The Washington law regarding when entrance upon private property is lawful is as follows:

RCW 16.08.050: Entrance on private property, when lawful.

A person is lawfully upon the private property of such owner within the meaning of RCW 16.08.040 when such person is upon the property of the owner with the express or implied consent of the owner: PROVIDED, that said consent shall not be presumed when the property of the owner is fenced or reasonably posted.
